Standard Terms and Conditions of the offer
Warranty:
The Equipment quoted is covered by the manufacturer's standard warranty for 12 calendar months from the date of delivery. This warranty does not cover electrical items like bulb, switches etc. rubber items including tires, belts etc., and other items of normal wear. In the case of the prime mover, the manufacturers’ warranty shall be passed on to the customer. The warranty does not cover repairs done without our approval / Defects arising out of improper use. We do not accept any responsibility for consequential damages or cost for alternatives/repairs.
Erection and Commissioning:
Erection and Commissioning shall be done under the supervision of our engineers. For plant/machine company shall depute 2 service persons for a maximum period of 15 days. To and from travel charges, Boarding and Lodging is to be provided by the customer. Max 1 visit for three days, the number of visits will be restricted if not utilized properly. Our service engineer will carry out E & C free of cost for three days. However, after three days, it will be charged USD 100 per day per engineer.
The tools and tackles like a crane, welding equipment, all consumable, other accessories and the skilled/unskilled manpower to be provided by the customer.
Foundation drawing shall be handed over along with the Order Acknowledgement.
The terms and conditions given under erection and commissioning are applicable only of the equipment is located in India.
Validity:
Our offer is open for acceptance for a period of 15 days from the date of our offer.
Price Variation:
The prices offered are based on the present-day cost of various components, raw materials, wages etc. and if there is any revision in prices of any of these items, our prices will be adjusted accordingly.
After Sales Support:
We will provide a service engineer if you pay for that and also we will provide all the necessary parts with the standard price if you need in the future.
Cancellation / Alteration:
Order once placed are not subject to cancellation/alteration unless the purchaser agrees to pay 10% of the value as incidental expenses thereon provided always that such information is received by us before making any progress with regard to design or drawing work, material procurement, manufacture etc. However, if such intimation is received after the work has already progressed, the purchaser will be required to pay in addition to the incidental expenses, a sum in proportion to the progress of the work between the dates or receipt of the order the date of receipt of intimation regarding cancellation/alteration.
Inspection:
Inspection if required will have to be carried out at our works by your authorized representative at your cost within 15 days of the notice that the material is ready for dispatch. If the inspection is not carried out within 15 days of intimation, we shall consider that inspection is waived and submit our pro form for payment. We can offer only no-load test and visual inspection at our works.
Force majeure:
Our offer is subject to force majeure clause.
Arbitration:
Any dispute or difference arising between the parties hereto in connection with the contract obligations of the parties hereunder shall be referred to arbitration, in accordance with the provision of the Indian Arbitration Act 1940 or any statutory modifications or reenactment thereof. The venue of arbitration will be Ahmedabad.
Jurisdiction:
Contract will be subject to Ahmedabad Jurisdiction only.
Buyer sends back FCO with signs, stamps and also send Purchase Order mandatory.
